The Constitutional Court will discuss the issue of constitutionality of distrust of the Mayor

On 22 March 2019, the Constitutional Court will discuss the constitutional claim filed by GYLA in the name of Tamaz Mechiauri, the mayor of Tianeti.

The objective of the dispute is the provisions of the Local Self-Government Code, according to which the municipal assembly has the right to dismiss the elected mayor without any substantiation. Under the current legislation, the municipal assembly does not need to substantiate the fact that the mayor does not carry out his duties properly.

GYLA believes that such a procedure for declaring distrust of mayor is incompatible with the paragraph 1 of the article 25 of the Constitution, which guarantees the right to protect a person from the groundless dismissal from the public service.
