On December 29.2006 the Georgian Young Lawyers’ Association sent one more case to the European Court of Human Rights. The case concerned detention of the members of the NGO “Egalitarian Institute” and sentencing them to imprisonment for 30 days.
On July 29, 2006 members of the Liberty Institute: Irakli Kakabadze, Lasha Chkhartishvili, Jaba Jushkariani, Zurab Rtveliashvili and David Dalakishvili were publicly expressing their opinion on the current political situation in the country. By using the megaphone they appealed the court for impartiality and independence and requested dismissal of Shalva Ramishvili and David Kokhreidze –co owners of the TV channel 202. After five minutes court officers left the court building and detained the mentioned persons without giving them any warning. Afterwards they were lead to the appeal court and placed in a room. Later, the chair of the Appeal Court Eka Tkheshelashvili sentenced the applicants to 30 days of imprisonment, as per article 208 of the Criminal Procedure Code. The case was discussed without an oral hearing. Respectively, neither the applicants nor the lawyers participated in the hearing of the case. Moreover, as per article 208, paragraph 7 of the Criminal Procedure Code the court judgment could not be appealed.
The applicants complain on violation of articles 5,6,10,11,13 and article 2, of the protocol 7 of the European Court of Human Rights.
