GYLA submitted amicus curiae brief to the European Court of Human Rights concerning the case of “Rustavi 2 and Others v Georgia”.

The request of GYLA to participate as amicus curiae in Rustavi 2 case was granted by the European Court on 4 April 2018. The Court granted only the requests of GYLA and the Public Defender for permission to lodge third party interventions.

The European Court granted GYLA’s request entirely, allowing it to submit a brief concerning legal matters raised in the request. In addition, the Court explained that GYLA should not lodge submissions concerning factual circumstances of the case and the merit of the dispute.

GYLA lodged its written submissions within the specified time limit. The submissions provide an overview of decisions of the Supreme Court of Georgia in relation to Articles 85 and 89 of the Civil Code of Georgia (limitation period for rescission of transaction made by duress), as well as international standards and national legislation on assignment of cases.
