GYLA submitted to the Parliament opinion on the draft Police Law

On September 26, 2013 GYLA submitted its opinion to the Parliament on the draft Police Law.   Applicable Police Law was adopted in 1998 and is outdated, while the issue of substituting it with new legislative act compatible with international standards has been on the agenda long ago. The structure of the draft is well developed. It is important that key principles of police activities have been incorporated in a separate chapter and were improved. Nevertheless, GYLA considers that the draft contains significant gaps that needs to be improved.

GYLA’s Media Legal Defence Centre reacts on the developments in the public broadcaster

Eka Kvesitadze, the journalist of the public broadcaster was discharged from the office on the basis of the September 17, 2013 order of Tamaz Tkemaladze, the acting general director of the public broadcaster. As reported, the reason of dismissal was closing of the program “Accents”.    The journalist had contract with the public broadcaster until the end of 2013. As per Article 37 and 38 of the Labor Code, if the initiator of the invalidation of contract is an employee, he/she must notify the employer no lesser than thirty calendar days in advance in writing. In addition, the employer may use the restricted term of advance notification and inform the employee on termination of the Labor Contract three days earlier. In such case, the employer should reimburse to the employee two months compensation.

GYLA Held Presentation of the Report Prepared on Batumi Rehabilitation

Today, on September 24, 2013 GYLA held presentation of the report “Rehabilitation Process beyond the Façade”.  The report discusses in details the program for Rehabilitation of Historic Districts and Tourism Infrastructure in Batumi 2009-2013. The document also submits separately the projects funded within the program such as: construction of Alphabetic Tower and Piazza Square, as well as Historic Fort and Opera House in Batumi. The report also pays attention to the issue of cultural heritage in the process of implementing the program for Rehabilitation of Historic Districts and Tourism Infrastructure in Batumi 2009-2013.

GYLA and EMC release the joint statement on Tsulukidze’s and Bakhturidze’s case

Georgian Young Lawyers’ Association and the Human Rights Education and Monitoring Center release the joint statement on application of alleged disproportional police force while detaining Piruz Tsulukidze and Temur Bakhuntaridze and on their religious discrimination.     Tsulukidze’s and Bakhuntaridze’s case attracted public interest before their detention, when on August 10, 2013 information was disseminated on Interior Ministry’s prohibition to send P. Tsulukidze, the sportsman to the European Tournament. (Information released on media).

GYLA Discussed Regulations Restricting Photo-video Recording at the Polling Place on the Election Day

On September 20, 2013 GYLA’s Media Legal Defense Center held a meeting and discussed regulations restricting photo-video recording at the polling place on the Election Day. At the meeting, participants have discussed resolution#42 of the Central Election Commission of September 24, 2012 about imposing restrictions on photo-video recording at the polling place on the Election Day. In addition, GMLDC submitted the results of the implemented inquiry  among the journalists.

NGOs disseminate the joint statement on investigation of facts of torture in penitentiary institutions

A year ago, on September 18, 2012 mass media disseminated recordings illustrating prisoners’ torture and inhuman and degrading treatment in penitentiaries clearly demonstrating severity and scale of human rights’ violations in penitentiaries. The footage released on September 18 and later, confirmed the practice of ill-treatment previously pointed out by the public defender and NGOs actively. However, the state internal control mechanisms and bodies with investigative and prosecutorial responsibilities were too lenient and there was  absence of political will and action, which consequently encouraged the syndrome of impunity and practice of ill-treatment.

GYLA Media Legal Defense Center will protect Giorgi Baratashvili’s interests in a court

On September 6, 2013 Giorgi Baratashvili, the general director of the Public Broadcaster was dismissed from the office on the basis of announced distrust from the Board of Trustees. Today, Giorgi Baratashvili challenged Board’s decision in Tbilisi City Court. It is already the second case when GMLDC will represent his interests in a court.

Cases Successfully Litigated in July and August

  With the assistance from GYLA’s office individuals dismissed from “Children’s Youth National Center” of the Ministry of Sport and Youth Affairs of Georgia were restored to work     A lawyer from GYLA’s office in Tbilisi was representing N.A.’s, A.S.’s and M.Z.’s interests. They worked in LEPL “Children’s Youth National Center”. On December 31, 2012, upon decision of the Center, they were dismissed from the office unreasonably. The employer founded his decision on  Article 37(1d) of the Labor Court which has been interpreted for years in violation of employees’ interests.
