An Appeal complaint regarding Ana Dolidze`s avoidance from the session of the High Council of Justice

On January 11, 2019, Tbilisi Court of Appeal holds a court hearing, concerning Ana Dolidze`s avoidance from the session of the High Council of Justice. GYLA will advocate for Ana Dolidze`s interests, prior the period of interviewing judges for lifetime appointment, Ana Dolidzle had made public statements on problems linked to judiciary system, statements mentioned have become the ground for her avoidance.

At the session of December 14, Tea Dzimistarashvili was in the composition of the Appeal Court, she appeared to be a relative of a judge Ilona Todua, who, by her side, has been one of the judges submitting a motion to prevent Ana Dolidze off the session of the High Council of Justice. On the basis of GYLA`s attorney`s counsel, Tea Dzimistarashvili is withdrawn from the composition.

On December 21, Judge Tamar Oniani, who is an active member of the Council, joined the session as the third judge. During the council session of October-November, 2018, she voted for preventing Ana Dolidze from the judge interweaving process, on the same grounds, what is being disputed now. Since, Tamar Oniani represents the body, whose decisions are disputed, she has been withdrawn off the Appeal Board composition.

A speaker judge of the panel, considering the complaint in the Court of Appeal, is Giorgi Tkavadze, also nominated as a judge of the Supreme Court; at the hearing of January 11, he should consider GYLA`s counsel, on addressing the Constitutional Court, concerning constitutionality of a norm, which has become the ground to prevent Ana Dolidze off the session.[1]
